1. Introduction

These Terms & Conditions govern your access to and use of www.lubrdelivery.com.au (“the Website”), the Lubr Delivery platform, merchant portal, rider network, and all related logistics and technology services (“Services”).

By accessing or using the Website or Services, you agree to be bound by these Terms. If you do not agree, you must not use the Website or Services.

“Lubr Delivery”, “we”, “our”, and “us” refer to Lubr Delivery (ABN 55 496 457 37).

2. Our Services

Lubr Delivery provides:

  • Last‑mile delivery services for retail and wholesale stores

  • On‑demand and scheduled delivery across approved service zones

  • Merchant integration tools, including QR links, tracking pages, and API/HTML embeds

  • Rider/driver network management

  • Order processing, notifications, and settlement systems

  • Technology services enabling merchants to offer fast, discreet delivery to customers

We may update, modify, or discontinue any part of the Services at any time.

3. Merchant Eligibility

To partner with Lubr Delivery, merchants must:

  • Operate a valid business with an active ABN/ACN

  • Provide accurate business, banking, and compliance information

  • Sell products legally permitted for delivery within Australia

  • Comply with age‑restricted product laws (where applicable)

  • Maintain accurate stock availability and order information

We reserve the right to approve, decline, or suspend any merchant at our discretion.

4. Customer Eligibility

Customers using Lubr Delivery must:

  • Be at least 18 years old

  • Provide accurate delivery information

  • Be available to receive the order within the delivery window

  • Present valid ID when required (e.g., age‑restricted goods)

Failure to comply may result in cancellation or redelivery fees.

5. Ordering & Fulfilment

5.1 Order Process

Orders placed through merchant websites, QR codes, or Lubr Delivery integrations are transmitted to our system for fulfilment.

5.2 Delivery Windows

Delivery times are estimates only. Delays may occur due to traffic, weather, rider availability, or operational constraints.

5.3 Failed Deliveries

A delivery may be marked as failed if:

  • The customer is not present

  • The address is incorrect

  • ID cannot be verified

  • Delivery is unsafe or restricted

Redelivery or cancellation fees may apply.

6. Merchant Fees & Settlement

6.1 Fees

Merchants agree to the applicable fee structure, which may include:

  • Delivery fees

  • Transaction fees

  • Card processing fees

  • Subscription fees (if applicable)

  • Technology activation fees

Fee schedules are provided during onboarding and may be updated with notice.

6.2 Payouts

Merchant payouts are processed to the nominated bank account. Settlement times may vary depending on banking providers.

6.3 Chargebacks & Disputes

Merchants are responsible for providing accurate order information to minimise disputes. Lubr Delivery may withhold funds during investigation.

7. Rider & Driver Network

Riders and drivers engaged by Lubr Delivery operate as independent contractors. Lubr Delivery is not responsible for:

  • Loss or damage caused by rider negligence

  • Delays outside our reasonable control

  • Items incorrectly packaged by merchants

Riders may refuse delivery if the item is unsafe, illegal, or improperly packaged.

8. Packaging & Product Compliance

Merchants are responsible for:

  • Ensuring products are legal to sell and deliver

  • Complying with age‑restricted product laws

  • Providing secure, sealed, and safe packaging

  • Ensuring no prohibited or dangerous goods are sent

Lubr Delivery may refuse or cancel deliveries that breach compliance.

9. Technology & Platform Use

Merchants and customers must not:

  • Misuse the platform or attempt to bypass security

  • Reverse engineer or copy Lubr Delivery systems

  • Use the platform for unlawful purposes

  • Upload harmful or malicious content

We may suspend access for any misuse.

10. Intellectual Property

All content, branding, software, and materials on the Website are owned or licensed by Lubr Delivery. You may not reproduce, distribute, or modify any content without written permission.

11. Limitation of Liability

To the maximum extent permitted by law, Lubr Delivery is not liable for:

  • Loss of profits, revenue, or business

  • Delays or service interruptions

  • Loss or damage caused by third‑party contractors

  • Incorrect information provided by merchants or customers

Our total liability is limited to the amount paid for the specific delivery or service in question.

12. Indemnity

You agree to indemnify Lubr Delivery against any claims, losses, damages, or expenses arising from:

  • Your breach of these Terms

  • Your misuse of the Services

  • Your violation of laws or third‑party rights

13. Privacy

Your personal information is handled in accordance with our Privacy Policy. By using the Services, you consent to the collection and use of your data as outlined in that policy.

14. Termination

We may suspend or terminate access to the Website or Services at any time for:

  • Breach of these Terms

  • Fraudulent or unlawful activity

  • Operational or safety concerns

You may stop using the Services at any time.

15. Changes to Terms
